[월드투데이 김나혜 기자] 세계은행이 부정행위를 저지른 기업 'Bouygues Bâtiment International'에 제재를 가했다.
The World Bank has imposed sanctions on Bouygues B̂timent International, a company that engaged in collusive practice.

지난 4일 세계은행은 부정행위를 저지른 기업에 대한 12개월 조건부 불제재를 내렸다. 대상이 된 기업은 프랑스 기반 건설회사 'Bouygues Bâtiment International'로, 마다가스카르 공항 프로젝트에서의 담합행위와 관련하여 제재를 받게 됐다.
The World Bank Group announced the 12-month conditional non-debarment of France-based Bouygues Bâtiment International, a company specializing in complex construction projects worldwide, in connection with a collusive practice as part of the Airports Madagascar Project, on January 4.

마다가스카르 공항 프로젝트는 IFC가 마다가스카르 두 주요 공항인 이바토 국제공항과 파세네 공항의 증축, 개축 공사의 설계와 개발을 위한 자금을 부분적으로 지원한다. 이 기업은 공항 운영 28년 계약 기간 중 지난 2015년 2월 4일부터 5월 4일까지 정부 관계자들과 부적절한 회의에 참여하는 등 담합행위를 벌였다.
The project, which is supported by IFC, provides partial financing for the design and development of the expansion and renovation works of the two main airports in Madagascar: the Ivato International Airport and the Fascene Airport. Bouygues Bâtiment International engaged in a collusive practice by attending improper meetings with government officials, between February 4, 2015 and May 4, 2015, during the tender for the 28-year contract for the concession to run the airports.

제재조치는 세계은행의 'Integrity Vice Presidency'가 수행한 조사로부터 비롯됐다. 이것은 국제금융공사(IFC) 자금조달 사업에서 높은 청렴 기준을 달성하기 위한 세계은행의 노력을 강조한다. 이러한 합의는 어떻게 그러한 합의 및 세계은행의 제재가 민간부문 개발 프로젝트에 참여하는 기업들의 더 나은 사업 관행을 촉진하는 데에 사용될 수 있는지를 보여준다.
The sanction stems from an investigation that was conducted by the World Bank Group’s Integrity Vice Presidency and highlights the institution’s efforts to promote high integrity standards in International Finance Corporation (IFC)-financed projects. The matter was resolved through settlement agreements that were negotiated with the multiple companies involved. The settlements demonstrate how such agreements, and Bank Group sanctions in general, can be used to help promote better business practices by companies engaged in private sector development projects.

'Bouygues Bâtiment International'이 조건부 불제재를 받았다는 것은, 이 기업 및 계열사인 'Entreprise Internationale de Construction (EIC)'가 합의안에 따른 의무를 준수하는 경우 세계은행 기관에서 자금을 조달하는 프로젝트 및 운영에 참여할 수 있는 자격을 유지함을 의미한다.
The sanction of conditional non-debarment means that Bouygues Bâtiment International and its sanctioned affiliates—Entreprise Internationale de Construction (EIC)—will remain eligible to participate in projects and operations financed by institutions of the World Bank Group provided that it complies with its obligations under the settlement agreement.

그런데 만약 세계은행이 그러한 의무들이 12개월 내에 달성되지 못했다고 판단하면, 조건부 불제재는 더 강한 제재로 바뀌어 기업은 합의서의 조건이 충족될 때까지 세계은행이 자금을 조달한 활동에 참여할 수 없게 된다.
If the World Bank Group Integrity Compliance Officer determines that these obligations are not satisfied within a 12-month period, the conditional non-debarment will convert to a sanction of debarment with conditional release, and the company and its affiliate will then become ineligible to participate in World Bank Group-financed activities until the conditions for release set out in the settlement agreement are met.
